What needs to take place

TERMS OF BUSINESS FOR THE SALE OF RESIDENTIAL PROPERTY

We are required by the Estate Agents Act 1979 to advise you of the information below prior to receiving or confirming your instructions.

SOLE AGENCY

This is when you agree to instruct this company to the exclusion of all others. You will become liable to pay our fee if at any time unconditional contracts for the sale of the property are exchanged with a purchaser introduced by us during the period of our sole agency, or with whom we had negotiations about the property during that period, or with a purchaser introduced by another agent during that period.

The sole agency period will continue until terminated by either party, giving to the other fourteen days written notice.

MULTIPLE AGENCY

This is when you decide to instruct this company in addition to any number of other estate agents. You will become liable to pay our fee if at any time unconditional contracts for the sale of the property are exchanged with a purchaser introduced by us during the period of the agency, or with whom we had negotiations about the property during that period.

OTHER MATTERS

No additional charges for advertising, sale boards or other items will be made, unless agreed to by you, beforehand.

Our fees are to be paid by your solicitor on the day of completion out of proceeds received.

In the unlikely event of you wishing to withdraw your property, we will require fourteen days written notice.

We will report any offer made for your property promptly and in writing.

In the exceptional circumstance where contracts are exchanged but fail to be completed, we require payment of one half of the fees described above.

LETTINGS

Tenancy Application Forms:-

Once you have chosen a property, you will need to complete a Tenancy Application Form.

This should be returned to us with a payment for the relevant tenancy administration fee made payable to "GND Properties". You may withdraw your application within 24 hours and receive a full refund of the holding deposit. After that the fee will be forfeited if the application is withdrawn.

NB: We will not remove a property from our availability list until we receive a completed application and administration fee. It is therefore imperative that you get your application to us at your earliest opportunity.

On occasion we may receive more than one application on a property.  Our commitment is that we will only ever process one application at a time on a property so if multiple applications are received a decision will be made as to which application we will progress.  The other parties will be informed at the earliest opportunity and receive a full refund of any amounts paid.  We will also endeavour to find suitable alternative accommodation.

References & Guarantors

Upon receipt of the application we will either utilise the services of Managing Agents Reference Assistant Services Limited or take references directly from your employer, previous landlord and a character referee.  We may also carry out a credit reference check with Equifax.  

In certain circumstances a guarantor may be required. The guarantor is normally a member of the applicant's family who is of sufficient means to guarantee the payment of rent.

As a result, Landlords have come to expect extensive knowledge and expertise from the Agency they choose to act in their interests.
